I am an active-duty U.S. Army Soldier who completed Basic Combat Training and has remained in a holdover status at Fort Jackson for an extended period. I have been under investigation related to alleged misconduct. CID completed its investigation and referred the matter to the Office of the Staff Judge Advocate/Office of the Special Trial Counsel (OSTC), where it has remained pending for many months. During this process, I have experienced significant administrative delays and conflicting information regarding my case status, including issues involving pay, administrative handling, and the status of a pending administrative separation. My Trial Defense Service attorney has been communicating with OSTC, but no final decision has been made regarding whether the matter will proceed through military justice or be returned to command for administrative disposition. I am seeking legal advice to better understand my rights, evaluate whether the process has been handled properly, and determine what legal options may be available at this stage.
